Attend Care Pty Ltd, referred to in this Website Privacy Statement as “Attend Care”, “we”, “us” or “our”, respects your privacy and is committed to protecting the personal information collected through our website at https://attendcare.com.au/.

This Website Privacy Statement explains how we collect, hold, use and disclose personal information obtained through our website, website forms, cookies, analytics tools, newsletter subscriptions and other online interactions.

This statement applies to website visitors, prospective participants, family members, nominees, guardians, support coordinators, referrers, healthcare professionals, job applicants and other people who communicate with us through the website.

This statement does not replace Attend Care’s internal Privacy and Confidentiality Policy or other policies governing information collected during the delivery of NDIS supports and services.

2. Our privacy obligations

Attend Care manages personal information in accordance with applicable Australian privacy requirements, including:

  • the Privacy Act 1988 (Cth);
  • the Australian Privacy Principles;
  • the Health Records Act 2001 (Vic), where health information is collected;
  • the Spam Act 2003 (Cth);
  • applicable National Disability Insurance Scheme legislation, rules and standards; and
  • other applicable Commonwealth, state and territory laws.

As a registered NDIS provider, Attend Care recognises each participant’s right to privacy, dignity, choice and control.

3. What personal information we collect through the website

The personal information collected depends on how you interact with the website. It may include:

  • your name;
  • telephone or mobile number;
  • email address;
  • residential or postal address;
  • details provided in an enquiry, contact or referral form;
  • information about your interest in Attend Care’s services;
  • information about an NDIS participant where submitted by the participant or an authorised representative;
  • NDIS plan or funding information voluntarily provided through a website enquiry;
  • details of a family member, nominee, guardian, support coordinator, referrer or healthcare professional;
  • communication preferences;
  • newsletter subscription details;
  • job application information, including employment history, qualifications, experience, curriculum vitae, cover letter and referees;
  • information about your right to work in Australia;
  • information generated through your use of our website, including your Internet Protocol address, browser type, device information, pages viewed, links selected and the date and time of your visit; and
  • any other information you voluntarily provide through the website.

Some website enquiries or referrals may contain sensitive information or health information, including information about disability, medical conditions, support needs, cultural background or personal circumstances.

We only collect sensitive and health information through the website where:

We may also receive website-related information from an authorised representative, family member, guardian, nominee, support coordinator, referrer, healthcare professional, recruitment provider or related service provider.

If you provide personal information about another person, you must be authorised to provide it and, where appropriate, make that person aware of this Website Privacy Statement.

6. Why we collect and use personal information

We may collect and use website information to:

  • assess whether Attend Care’s services may be suitable for a prospective participant;
  • contact prospective participants or their authorised representatives;
  • process and respond to referrals;
  • arrange consultations, appointments or callbacks;
  • communicate with support coordinators, referrers and healthcare professionals;
  • process job applications and employment enquiries;
  • manage newsletter subscriptions and marketing preferences;
  • send service information, updates and communications where permitted;
  • administer and improve the website;
  • understand how visitors use the website;
  • maintain website security and prevent fraud, misuse or unauthorised access;
  • comply with our legal, regulatory and reporting obligations;

  • an NDIS participant’s authorised nominee, guardian or representative;
  • support coordinators, plan managers, healthcare professionals and other service providers involved in responding to an authorised enquiry or referral;
  • our parent company, EDUK8U TVET Grad School Asia Pty Ltd, and authorised shared-services personnel;
  • website developers, hosting providers and information-technology support providers;
  • Google Workspace and related Google services;
  • GoHighLevel CRM and email communication services;
  • Prodigy workforce management services, where relevant;
  • Xero, where information is required for approved financial or administrative purposes;
  • analytics, communications, scheduling and website-plugin providers;
  • professional advisers, including lawyers, accountants, auditors, insurers and compliance advisers;
  • government agencies, regulators, courts, tribunals and law-enforcement bodies where required or authorised by law; and
  • another party where you have consented to the disclosure.

We do not sell personal information.

9. Overseas access and disclosure

Attend Care is a wholly owned subsidiary of EDUK8U TVET Grad School Asia Pty Ltd and uses shared-services personnel based in Malaysia. Authorised personnel in Malaysia may access certain operational, enquiry, recruitment, website and administrative information where access is necessary for their authorised duties.

Some cloud, analytics, CRM, email, hosting and technology service providers may also process or store information outside Australia. Depending on the provider and system configuration, these locations may include Malaysia, the United States and other countries in which those service providers or their subcontractors operate.

Where personal information is disclosed to an overseas recipient, Attend Care will take reasonable steps required under applicable privacy law to ensure that the information is handled appropriately.

By submitting personal information through the website, you acknowledge that it may be accessed or processed in the locations described above, subject to applicable legal safeguards.

Our website may use cookies and similar technologies to:

We will process unsubscribe requests within the period required by law.

Unsubscribing from marketing communications will not prevent Attend Care from sending essential administrative, service-related, legal or safety communications where those communications are otherwise permitted.

13. Job applications

When you apply for a role or submit an employment enquiry through the website or a linked recruitment platform, we may collect and use your information to:

  • assess your suitability for current or future opportunities;
  • communicate with you about your application;

Nothing in this section limits any right to make a complaint to the NDIS Quality and Safeguards Commission or another relevant regulator.

18. Data breaches

Attend Care maintains processes for responding to suspected or confirmed privacy and data-security incidents.

Where a data breach is likely to result in serious harm and notification is required under the Notifiable Data Breaches scheme, Attend Care will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Privacy Act 1988.

We may also notify other regulators where required by law.

19. Children and people requiring support to provide information

Our website is not directed specifically at children.

Where website information concerns a child or a person who requires decision-making support, the information should be provided by the person, their parent, guardian, nominee or another person authorised to act on their behalf.

Attend Care recognises the importance of supported decision-making and will take reasonable steps to communicate privacy information in an accessible manner.
